What are the notice and timeline provisions when a child is apprehended by the Agency?
The agency has within five working days if they are bringing an application to the court. The agency must provide the parties with at least two days’ notice unless notice is waived by the parties or by the court.
Who does a Band Designate represent?
The Band Designate represents the child’s First Nation Band in child protection proceedings before the court.
If your Band has appointed a Band Designate, they can:

- Help identify culturally appropriate services and potential placements;
- Help parents or caregivers navigate finding a lawyer; and
- Remind parents or caregivers of court dates.
